Terms of Use

Welcome to MindScape. These Terms of Use ("Terms") govern your use of the MindScape mobile application ("App") provided by Davide Miron ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Description of Service

MindScape is an exam pressure tracking application designed to help students manage study stress. The App provides features including:

• Study session tracking and exam scheduling
• Customizable reminders and notifications
• Analytics and progress visualization
• Focus timer functionality
• Streaks and achievement system

2. Eligibility

You may use MindScape if you are at least 13 years old (or 16 years old in the European Economic Area). If you are under the age of majority in your jurisdiction, you must have permission from a parent or legal guardian to use the App.

3. User Account

MindScape does not require you to create an account. All your data is stored locally on your device. You are responsible for maintaining the security of your device and any data stored within the App.

4. Subscription Terms

4.1 Subscription Plans

MindScape offers premium subscription plans with additional features:

Prices may vary by region and are subject to change. The actual price will be displayed in the App before purchase.

4.2 Auto-Renewal

• Payment will be charged to your Apple ID account at confirmation of purchase
• Your subscription will automatically renew at the same price unless you cancel at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase

4.3 Free Trial

If a free trial is offered, any unused portion of the free trial period will be forfeited when you purchase a subscription.

4.4 How to Cancel

To cancel your subscription:

1. Open the Settings app on your iPhone
2. Tap your name at the top
3. Tap "Subscriptions"
4. Select "MindScape"
5. Tap "Cancel Subscription"

5. Refund Policy

All purchases are processed by Apple through the App Store. We do not have direct access to your payment information or the ability to process refunds.

To request a refund:

• Visit reportaproblem.apple.com
• Sign in with your Apple ID
• Select the purchase you want to request a refund for
• Follow Apple's instructions to submit your refund request

Refund eligibility is determined by Apple in accordance with their refund policies.

6. Acceptable Use

You agree to use MindScape only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App in any way that violates any applicable law or regulation
• Attempt to reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any proprietary notices in the App
• Use the App to transmit any viruses, malware, or other malicious code
• Attempt to gain unauthorized access to any part of the App or its systems
• Use the App in any manner that could damage, disable, or impair the App
• Use any automated system to access the App

7. Intellectual Property

The App and its original content, features, and functionality are owned by Davide Miron and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

8. User Data

You retain ownership of all data you enter into the App. By using the App, you grant us permission to store this data locally on your device to provide the App's functionality. For more information about how we handle your data, please see our Privacy Policy.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The App will meet your specific requirements
• The App will be uninterrupted, timely, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• Any errors in the App will be corrected

MindScape is a productivity tool and is not intended to replace professional academic, medical, or psychological advice. If you are experiencing significant stress or mental health concerns, please consult a qualified professional.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DAVIDE MIRON BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data
• Loss of profits
• Loss of goodwill
• Service interruption
• Computer damage or system failure

Our total liability for any claims arising from or related to these Terms or the App shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Davide Miron from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the App or violation of these Terms.

12. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last Updated" date at the top of these Terms. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Italy.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Davide Miron regarding the use of the App and supersede any prior agreements.

17. Apple App Store Terms

These Terms are between you and Davide Miron only, not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any); Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the App. Apple is a third-party beneficiary of these Terms and may enforce them against you.
